Acceptance of Terms

By accessing and using the services provided by OBoundFirst, you agree to be bound by these Terms of Service. If you don't agree with these terms, you should not use our services.

Description of Service

OBoundFirst is a B2B outbound marketing and sales automation agency. Our goal is to provide comprehensive, "Done-For-You" (DFY) outbound campaign solutions that run on autopilot, while still maintaining a personal, human touch. Our services include:

• Prospect research and list building
• Personalized messaging and copywriting
• Technical infrastructure setup and management (domains, mailboxes, etc.)
• Continuous A/B testing and optimization
• Automated campaign management and analytics

Client Obligations

As a client, you agree to:

• Provide accurate and complete information, including your ideal customer profile (ICP).
• Cooperate during the onboarding process to ensure a smooth setup.
• Use our services in compliance with all applicable laws and regulations.

Payment Terms

Our services are provided on a month-to-month subscription basis. A single monthly fee covers all associated costs, including all infrastructure, tools, and management fees. All fees are non-refundable. We reserve the right to modify our pricing with reasonable notice.

Intellectual Property

The services, our proprietary methods, and all original content are and will remain the exclusive property of OBoundFirst and its licensors. Upon full payment for a service period, you retain ownership of your business data and brand materials, as well as the specific campaign copy and prospect lists we create for you.

Data and Privacy

We take data security seriously. Your use of our services is also governed by our Privacy Policy. You retain ownership of your business and customer data, and we will not use it for any purpose other than providing our services to you.

Limitation of Liability

In no event shall OBoundFirst be liable for any indirect, incidental, special, or punitive damages, including loss of profits, data, or other intangible losses. While our services are designed to generate results, we do not guarantee a specific number of meetings or a particular business outcome, as results can vary.

Service Availability

We strive to maintain high service availability. We take full responsibility for the technical infrastructure used for your campaigns. If any domains or mailboxes encounter deliverability issues, we will replace them immediately at no additional cost to you.

Termination

Our agreement is month-to-month with no long-term contracts. Either party may terminate the service agreement at any time. Upon termination, your right to use the service will cease immediately. If you choose to pause your campaigns, you can do so by either canceling the infrastructure (requiring a new 3-week setup upon restart) or by paying 50% of your subscription fee to maintain the health and warmth of your mailboxes.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of any material changes, and your continued use of the service after such changes constitutes your acceptance of the new terms.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OBoundFirst is registered.
